Terms of Service & Community Agreement

1. Strict Age Requirement and Legal Eligibility

This platform provides sexually explicit, adult-oriented live broadcasting and interactive communication. Access is strictly conditioned upon your legal adult status. You represent and warrant under penalty of perjury that:

• You are at least eighteen (18) years of age, or the age of legal majority in the jurisdiction from which you access the platform (e.g., twenty-one (21) where local law mandates).
• You possess the legal authority, capacity, and mental competence to enter into this legally binding Agreement.
• Adult sexually explicit material is legal in your local jurisdiction, municipality, state, and country.
• You are accessing this website for your own personal, non-commercial entertainment and will not permit any minor or unauthorized third party to view or access your device while connected to Stripchat.

2. Scope and Nature of Services

Stripchat operates as an open, decentralized technological intermediary and communications platform. We provide the infrastructure—including WebRTC video pipelines, real-time text chat, Bluetooth Lovense teledildonic hardware relay APIs, and virtual token processing—that allows independent adult performers ("Broadcasters" or "Models") to broadcast live audiovisual feeds to consenting adult viewers worldwide.

You explicitly recognize that Broadcasters operate as independent contractors and not as employees, agents, or partners of Stripchat. Each Broadcaster exercises sole editorial autonomy over their broadcast room, performance choices, schedules, tip goals, and interaction guidelines within the boundaries of platform safety policies. Stripchat does not guarantee the availability, schedule, artistic content, or duration of any specific model’s live feed.

3. Account Registration, Anonymity & Security

While public cam feeds may be viewed without creating an account, engaging in chat, tipping performers, controlling interactive toys, or entering private sessions requires account registration. When creating an account:

• Pseudonymous Usernames: You may choose any unique handle that does not infringe upon third-party trademarks, promote hate speech, or impersonate other persons or staff members.
• Credential Safeguards: You are solely responsible for maintaining the confidentiality of your login email, password, and two-factor authentication (2FA) credentials. All activities occurring under your registered account are your exclusive responsibility.
• Prohibition of Multi-User Sharing: User accounts are strictly individual and non-transferable. You may not sell, lease, gift, or share your credentials with third parties.
• Suspicious Activity: If you suspect unauthorized access or security compromises involving your account, you must immediately notify Stripchat customer support to initiate credential resets.

4. Token Economy, Virtual Goods & Financial Terms

Stripchat utilizes a digital micro-currency known as "Tokens." Tokens represent a limited, revocable, non-transferable virtual license used solely on Stripchat to tip broadcasters, initiate private shows, unlock media sets, and trigger interactive Bluetooth toys.

• No Real-World Cash Value: Tokens are virtual digital goods. For members and viewers, tokens do not constitute real currency, legal tender, or an investment asset, and cannot be redeemed for fiat currency back to the user.
• Non-Refundable Purchases: All token bundle purchases, VIP subscriptions, ticket entries, and tips sent during live shows are final and non-refundable once delivered, in full accordance with applicable electronic commerce regulations.
• Discreet Billing Descriptors: Payment transactions processed via debit card, credit card, or digital gateway appear under ambiguous billing descriptors such as "EPO*Billing" or "ST-ECOM Services" to preserve your financial discretion.
• Cryptocurrency Transactions: Where cryptocurrency payments (BTC, ETH, USDT, LTC, USDC) are accepted, users bear sole responsibility for verifying wallet addresses and network gas fees. Cryptographic transactions are irreversible once confirmed on the blockchain.
• Chargebacks and Fraud: Initiating fraudulent chargebacks, friendly fraud disputes, or utilizing unauthorized payment methods constitutes a material breach of this Agreement. Any account associated with chargebacks will be permanently suspended, remaining balances forfeited, and delinquent accounts referred to recovery agencies.

5. Live Streams, Cam-to-Cam (C2C) & Teledildonic Devices

Stripchat supports various broadcast tiers designed to cater to diverse viewing preferences:

• Free Public Chat: Broadcaster video and text chat are accessible to all registered and non-registered visitors without cost.
• Ticket Shows: Fixed-price group performances where admission tokens are deducted prior to show commencement. Shows run based on performer goals.
• Private Shows & Spy Mode: Confidential one-on-one sessions billed at designated per-minute token rates. Users entering in Spy Mode acknowledge viewing an active private show at a discounted rate without two-way communication.
• Cam-to-Cam (C2C) Video Feed: Activating your webcam during private sessions transmits your encrypted video feed directly to the model. You warrant that anyone appearing on your camera is at least eighteen (18) years old and has provided explicit consent to be broadcast. Displaying non-consenting individuals, minors, or illegal conduct on your C2C feed will result in immediate termination and referral to law enforcement.
• Bluetooth Hardware (Lovense) Relay: Token tips trigger software commands relayed via Bluetooth Low Energy (BLE) to hardware devices paired by performers. Stripchat disclaims any liability for local hardware malfunctions, battery depletion, or Bluetooth dropouts on the performer’s end.

6. Prohibited User Conduct and Content Standards

To preserve a safe, respectful, and legally compliant community, all users agree not to engage in any prohibited conduct. You agree that you will NOT:

• Harass, stalk, threaten, extort, or demean Broadcasters, moderators, or fellow viewers.
• Attempt to solicit off-platform meetings, direct financial transactions, personal residential addresses, phone numbers, or private identities from models.
• Transmit hate speech, racism, discriminatory slurs, or content promoting non-consensual sexual violence, bestiality, necrophilia, or bodily harm.
• Distribute unsolicited commercial advertising, spam messages, promotional referral links, or malware.
• Deploy automated bots, scraping spiders, API crawlers, or algorithmic scripts without our prior written authorization.
• Interfere with stream delivery, execute Denial of Service (DoS/DDoS) attacks, or reverse-engineer the platform’s WebRTC and WebXR software layers.

7. Intellectual Property & Recording Prohibition

All visual streams, broadcasts, high-resolution photo sets, videos, trademarks, logos, audio feeds, and platform designs are protected under international copyright, trademark, and intellectual property laws.

8. 18 U.S.C. § 2257 Record-Keeping Compliance

All performers, actors, models, and individuals broadcasting on Stripchat have undergone rigorous government photo identification verification, confirming they were at least eighteen (18) years of age at the time of broadcast. Records required pursuant to 18 U.S.C. § 2257 and 28 C.F.R. Part 75 are maintained by the appropriate records custodian designated in our legal disclosure statements.

9. DMCA Copyright Notice and Takedown Policy

Stripchat respects the intellectual property rights of creators and adheres to the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe that your copyrighted work has been utilized, copied, or broadcast on the platform without authorization, you may file a formal DMCA Notice with our Designated Copyright Agent containing:

• A physical or electronic signature of the copyright holder or authorized representative.
• Identification of the copyrighted work claimed to have been infringed.
• Direct URL links pointing specifically to the infringing broadcast or media archive.
• Your full contact details, including legal name, address, telephone number, and official email.
• A statement of good faith belief that the disputed use is not authorized by the copyright owner or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the owner.

10. Disclaimers of Warranties & Limitation of Liability

THE STRIPCHAT PLATFORM, SERVICES, CHATROOMS, WEBRTC STREAMS, AND VIRTUAL TOKENS ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, UPTIME AVAILABILITY, OR NON-INFRINGEMENT.

IN NO EVENT SHALL STRIPCHAT, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA CORRUPTION, SERVICE INTERRUPTIONS, OR HARDWARE FAILURE) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN JURISDICTIONS WHERE THE LIMITATION OF LIABILITY IS RESTRICTED, OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO STRIPCHAT IN THE PRECEDING THREE (3) MONTHS.

11. Indemnification, Termination & Modifications

Indemnification: You agree to defend, indemnify, and hold harmless Stripchat, its corporate entities, affiliates, and representatives from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising from your violation of this Agreement, unauthorized stream recording, or misuse of the platform.

Termination: We reserve the unilateral right to suspend, terminate, or revoke your account and access to the platform without prior notice if we discover violations of this Agreement, suspected fraud, or illicit conduct.

Modifications: Stripchat periodically updates these terms to reflect technological enhancements, operational changes, or legal statutes. Updated versions will be published with an updated Effective Date. Continued use of the platform after changes are posted constitutes full acceptance of the revised Agreement.

12. Governing Law, Dispute Resolution & Arbitration

This Agreement and any disputes arising directly or indirectly from your use of Stripchat shall be governed by and interpreted in accordance with applicable general commercial laws, without regard to conflict of law principles.

Mandatory Binding Arbitration: Except for equitable actions seeking immediate injunctive relief against unauthorized recording or intellectual property theft, any controversy or dispute shall be resolved through confidential, individual binding arbitration. You explicitly waive any right to initiate, join, or participate in class action lawsuits, representative proceedings, or collective arbitrations against Stripchat.
